Terms and conditions

MURÁ SAS is a commercial company legally created under the laws of the Republic of Colombia, dedicated to the production and marketing of high quality equestrian sports clothing, made with materials that allow high performance by the rider. These terms apply exclusively to purchases made in its online store or social networks. It is an essential requirement to access, use, register or carry out any legal act, in or through the Portal, the prior acceptance of the Terms and Conditions contained in this document. Such acceptance is made at the time of entering your personal data in the purchase or customer registration form. Any person who has entered their data in the purchase or Customer Registration form must be a person capable according to the laws of the Republic of Colombia to carry out successful commercial transactions in the online store. MURÁ may verify the identity of the people registered in the form. Therefore, the client declares that he/she knows and accepts each and every one of the indications established in these Terms and Conditions and the data privacy policies. Any person who does not accept these Terms and Conditions, the returns and warranty policy and the MURÁ Data Processing Policy, which are mandatory and binding, may not enter into legal acts in the online store. A minor may browse and explore the website, but may not enter into any valid legal act. In the event that a minor wishes to purchase the products displayed, he or she must do so through a person with legal capacity or his or her legal representative.

MURÁ reserves the right to unilaterally modify these Terms and Conditions, exchange and return policy and personal data processing policy, in whole or in part, at any time and without prior notice or communication.

MURÁ will publish the modification on the Site, adding the modified terms. From the date of modification of these Terms and Conditions, all transactions between MURÁ and the client will be governed by said modified document. For this reason, the Client undertakes to verify the Terms and Conditions before carrying out each transaction.

The Client's use of the Site after changes have been made to these Terms and Conditions shall constitute the Client's acceptance of such changes. If the Client does not agree, the Client must refrain from using the Site.

MURÁ may also unilaterally modify the design, presentation or configuration, the purchase, registration or use requirements on the Site.

  1. Definitions

For the purpose of understanding these terms and conditions, we will proceed to make the following definitions:

  • Portal or Platform: Web and mobile application managed by MURÁ and which has the possibility of offering its brand products in which different products are offered, which describe their characteristics to be observed through the page by the clients of the website who have registered their personal data and have accepted these terms.
  • Website customers. These are people who register their data through the website to view the products offered by MURÁ SAS through the portal or platform.
  • Consumers or Clients: Any person, resident in Colombian territory or outside of it, of legal age, with legal capacity, who wishes to satisfy their clothing needs by entering into a sales contract with MURÁ through the online store or social networks.
  • Payment methods: This is the method chosen by the client to make the payment for the transactions that may be generated within the portal. This may be through the payment gateway.
  • Payment gateway. Service that allows customers to make payments directly to MURÁ SAS, through electronic means using technological platforms (software).
  • Completion of the sales contract. For all legal purposes, the sales contract will be deemed to be completed when the portal determines that payment has been successful.
  • Customer Account: This is the account that is generated once the Customer registers their data on the portal and accepts the terms and conditions and privacy policies.

Once the above definitions are understood, the procedures for a client to validly enter into the sale of goods and services acquired through the portal or platform will be indicated:

  1. Customer registration and account use.

In order to make full use of the Site, you may register and access all the options offered by MURÁ. Registering in the store is free of charge. You must complete the registration form in all its fields with valid, exact, precise and true data and undertake to update, complete and correct your personal data as necessary. The Company may use various means to identify its customers, but is not responsible for the accuracy of the personal data provided by them. Customers guarantee and respond, in any case, for the truthfulness, accuracy, validity and authenticity of the personal data entered.

MURÁ reserves the right to request any additional proof and/or information in order to corroborate personal data. If an inconsistency is found in the customer's information at the time of registration or if the customer fails to notify any change, MURÁ may proceed to cancel the order and close the account of the person selling the products offered by MURÁ.

The client will access his/her personal account, hereinafter the “Account”, by entering the client's chosen personal security code. The client is obliged to maintain the confidentiality of his/her security code.

The Client assumes full responsibility for the confidentiality of the secret key of his Account. He will have the possibility of changing the key by accessing the “change password” option on this page, as well as recovering his key through an email validation in case he does not remember his registration key. The delivery of the Account data to third parties exonerates MURÁ from all responsibility for unrecognized consumption or any damage that may arise from the entry and/or access of third parties to his Account.

The Account is personal, unique and non-transferable, and it is prohibited for the same client to register or have more than one Account. In the event that the Company detects different Accounts that contain matching or related data, it may cancel, suspend or disable them unilaterally and immediately.

The client will be responsible for all operations carried out in his/her Account, since access to it is restricted to the entry and use of his/her security code or password, which is known exclusively to the client. The client undertakes to notify MURÁ immediately through the authorized communication channels of any unauthorized use of his/her Account, as well as any access by unauthorized third parties to it. It is clarified that the sale, assignment, transfer or leasing of the Account under any title or concept is prohibited.

MURÁ reserves the right to reject any activation request, as well as to cancel a previously accepted activation, without being obliged to communicate or explain the reasons for its decision and without this generating any right in favor of the client.

  1. Product display and availability

MURÁ publishes product images as clearly and accurately as possible. However, the display of colours will depend on the monitor from which the Site is accessed. In this regard, the Client and the Advisor understand that the published images are merely indicative and may be subject to changes at any time.

MURÁ may modify and discontinue products at any time without incurring any liability to the Site's Clients.

  1. Successful purchase procedure

For a consumer's purchase to be successful, the website client and/or consumer must complete the following steps:

  • The customer will enter the muraecuestre.co portal or online store, where they will be able to see the products that are in inventory available for consumption.
  • Customer data may be shared to contact and communicate products, promotions, collections and changes that may occur in the digital channel.
  • The website customer who enters the online store will be able to see the products displayed there for consumption.

The payment methods enabled by the payment gateway – MURÁ payment processor – Mercado Pago (national payments) and PayPal (international payments) – are:

  • Credit cards
  • Debit cards

Order cancellation requests must be made directly to MURÁ, as well as returns, new products or guarantees.

The sales contract will be concluded with the delivery and payment of said product.

Once the consumer has placed the order, a purchase order will be generated and sent to them via email. This order will provide an estimate of the delivery date according to the selected destination.

If the delivery is not made within the maximum delivery time stipulated in the purchase order, the consumer may cancel the order and the amount paid will be refunded within 15 business days following the cancellation.

The consumer may make use of the right of withdrawal contained in the consumer statute and our policy on returns, guarantees and right of withdrawal ( Return Policies )

MURÁ will be responsible for the product warranty as defined in the returns, guarantees and right of withdrawal policy ( Return Policies ).

  • Customer Rights When Purchasing Products Through The Web Portal

The platform client who decides to enter into a sales contract for the product(s) will have the following rights:

    • Buy the quantity of products you want and have the capacity to purchase as long as the inventory is available
    • Choose the payment method according to your needs and capabilities and that is in line with product shipping policies
    • Make any claims you may have as a consumer related to the purchasing experience through digital customer service channels (CHAT AND E-MAIL).
    • Receive the product within the term established in the Purchase Order.
    • MURÁ will reimburse the cost of the transport assumed by the Client when the order cannot be satisfactorily delivered to the Client. In the event that the Client partially returns the purchased order, MURÁ will not refund the cost of the transport.
    • Returns will have a value, as defined by the returns, guarantees and right of withdrawal policy ( Return Policies ).
  • Be notified of any changes made to these terms and conditions, return and warranty policies and personal data processing policy. If you do not accept the proposed changes, you may request the deletion of your Customer account.
  • In the event that the purchased product is not available, the Customer will have the right to a refund of the amount paid within the following 15 business days.
  • Track the location or shipping status of the purchased product(s).
  1. Customer Responsibilities When Purchasing Products Through The Web Portal

The Client will have the following responsibilities in the process of purchasing products through the portal:

  • Please read this document with terms and conditions, the personal data processing policy and the returns and guarantees policy.
  • Treat everyone involved in your shopping experience with respect.
  • Use the portal in accordance with the nature for which it was created, which is to market products through the website. If unauthorized use of the website is proven, the client will be blocked from the site.
  • Use the page solely and exclusively for the purposes of purchasing and satisfying products and services.
  • Respect ALL Intellectual Property rights of the MURÁ BRAND, consequently, you may not generate copies or replicas of any kind.

In the event that the Client does not respect the responsibilities defined within these terms and conditions or is using the page to carry out any act prohibited by the laws of the Republic of Colombia, he/she will be expelled from the website, his/her access will be blocked and MURÁ will file the respective complaints with the competent entity to sanction such conduct.

  1. Restrictions and Conditions on the Purchase of Products Through the Portal

The following restrictions and conditions apply to the purchase of products made by the Client through the portal:

  • The prices of the products defined on the portal include VAT, but do not include the cost of transport. This must be assumed by the consumer according to the place defined by the Client for delivery.
  • The portal for purchasing orders will only be available for certain areas of the national and international territory.
  • Promotions will be published on the platform, the validity, availability and quantities of the goods of said promotions or offers will be those defined in the advertising, the advertising must be in accordance with the rules issued for this purpose by the Superintendence of Industry and Commerce through resolutions or circulars and as defined by the Consumer Statute.
  • In the event that the promotions do not indicate the date of validity, it will be understood that it will last until the inventory is exhausted, the quantity of which will be defined in the advertisement.
  • The current prices for the products will be solely and exclusively those displayed on the virtual platform.
  • The delivery address of the products defined by the consumer and/or the holder of the Client account will be their sole responsibility, consequently, the consumer and/or holder of the account will assume the transportation charges in the event of registering any inaccuracy in the relationship of their address.
  • Product delivery will be made on the days and times defined by the delivery management with the contracted third party.
  • All purchases and/or promotions made at the same time will be delivered in one place.
  • The promotions or offers that MURÁ publishes on the Site are essentially sporadic and transitory.
  • Promotional products have the right to return. The right of withdrawal for promotional products will apply to the value paid and not to the cost of shipping.
  • MURÁ may offer discount coupons, which will have the validity defined in the voucher.
  • Discount vouchers or coupons cannot be combined with other promotions and can only be used once per customer on the account, unless the voucher advertisement states otherwise.
  • Products purchased through discount vouchers or promotions are not eligible for a refund, only the warranty.
  1. Shipping and delivery

MURÁ undertakes to ship and deliver the products within the time period specified at the time of the transaction on the Site, in accordance with the destination selected by the Customer. The indicated times include both the delivery of the products to the home address and the preparation and shipment of orders. The Site will indicate the delimitation of the delivery and distribution areas.

Products purchased by the Customer directly will be delivered to the address indicated by the Customer at the time of purchase. It is understood that any person who is at the address where delivery is to be made will be duly authorized to receive the order. In order to record the delivery and the conformity of the delivered product, a receipt must be signed. Consequently, MURÁ is exonerated from any liability for the delivery it makes, provided that it is made to the address registered on the Site.

If no one receives the order at the indicated address, MURÁ will make a subsequent delivery attempt and if delivery is not possible during this visit, MURÁ will return the products to its facilities. If the products have been previously cancelled, MURÁ will refund the value through the means by which the purchase was made within a period of no more than 15 business days.

Domestic shipping.

However, in our online store we want to deliver your order in the shortest possible time, which is why our delivery promise is:

  3. Deliveries to towns outside the urban area: 8 business days

Sometimes there are new developments that prevent us from fulfilling our promise, beyond our control, such as:

However, we want to assure you that this time will not exceed the period granted by the Consumer Statute for the delivery of your purchase .

  1. Claims Procedure

MURÁ is licensed to economically exploit all intellectual property rights relating to the brand, it does not have the capacity to license, or grant any right or authorization of use over its intellectual property rights described on this page, or any other type of property or right related to the Site. In order that THE CLIENT and/or THE CONSUMER can exercise their rights, MURÁ has provided the following channels of attention so that they can successfully submit their requests, complaints and claims:

For this right to be contested, it must contain the following essential requirements:

Full name of the applicant.

ID number.

Explain the reason for the request.

Contain a respectful request.

Correspondence address and/or e-mail.

The right to petition will be answered by the director of the area in charge and must provide a substantive response to your request within 15 business days after it has been received.

The response will have the right to appeal, which can be filed with the company's legal department within the following 10 business days, and the company will have a period of 30 business days to resolve the appeal if it is filed.

With the first response issued by the area in charge, the consumer and/or Client will be entitled to exercise consumer rights protection actions.
